1. Agreement
These Terms of Service ("Terms") govern your access to and use of GeoMapEngine ("the Service", "we", "us"), operated at geomapengine.com. By creating an account, installing the loader script, or using any part of the Service, you accept these Terms. If you use the Service on behalf of a company or agency, you represent that you are authorized to bind that entity.
2. The Service
GeoMapEngine is a local-SEO automation platform providing: programmatic geo-targeted landing hubs and map-signal networks, JavaScript content hydration, Google Business Profile publishing automation, geo-grid rank tracking, AI-generated content assistance, analytics, and client reporting. Features available to you depend on your subscription plan's entitlements.
We may add, modify, or retire features as the product evolves; material reductions to a paid feature you actively use will come with notice and a reasonable migration path.
3. Accounts & Eligibility
- You must be at least 18 and provide accurate registration information
- You are responsible for credentials, API keys, and all activity under your account — including actions by team members you invite
- One account per plan unless your plan explicitly provides team seats or agency sub-accounts
- Agency users: you are responsible for having your clients' authorization to manage their listings, websites, and data
4. Billing & Subscriptions
- Paid plans bill in advance monthly or annually through Stripe and renew automatically until cancelled
- Cancel anytime from Billing → your plan stays active through the paid period, then downgrades — no lock-in, no cancellation calls
- Plan changes take effect immediately and are pro-rated by Stripe
- Add-ons (extra seats, domains) bill monthly alongside the subscription and follow the same cancellation rules
- Prices may change with 30 days' notice; changes apply to your next renewal, never retroactively
- Failed payments: we retry for ~7 days, then the account is paused — your data is preserved for 60 days
- Taxes may apply based on your billing location
5. Refund Policy
14-day first-payment guarantee. New subscriptions may request a full refund of the first billing period within 14 days of the initial charge — no questions asked. Email [email protected] from your account email.
- The guarantee applies to a customer's first paid invoice only, once per account
- Usage-based charges that incurred third-party costs (live rank scans, AI generation, SMS/email sends) are deducted at documented cost where applicable
- Renewals, add-ons, and annual plans after the first period are non-refundable, but always cancellable — you keep access until the period ends
- We may, at our discretion, issue goodwill credits for verified service outages exceeding 24 consecutive hours
6. Acceptable Use
You may not use the Service to:
- Publish spam, deceptive, misleading, or unlawful content — to Google profiles, websites, or anywhere else
- Create listings or landing pages for businesses you are not authorized to represent
- Violate Google's Business Profile guidelines or represent fake/lead-gen listings as real businesses
- Manipulate rankings through fake reviews, keyword stuffing of business names, or other policy-violating tactics
- Probe, overload, reverse-engineer, or resell the Service outside the permissions of your plan
- Install the hydration script on websites you do not own or control
Violation may result in content removal, suspension, or termination. We may refuse service to any account at our discretion where legally permitted.
7. Third-Party Services & APIs
The Service integrates with Google Business Profile, Stripe, AI providers, rank-data providers, and map-tile providers. Your use of connected third-party features is also governed by their terms — including Google's Business Profile guidelines and API policies. We are not responsible for third-party service changes, outages, listing suspensions by Google, or policy actions by any platform.
8. AI-Generated Content
- AI output is assistance, not advice — you are solely responsible for reviewing accuracy, legality, and compliance of anything you publish
- Auto-publish mode posts AI content to your Google profile without review; you accept that responsibility by enabling it
- Do not publish AI content that misrepresents a business, fabricates claims, or violates platform policies
- You retain ownership of content generated for your account
9. Intellectual Property
The Service, its code, design, documentation, and branding are our property. Your data — business information, uploaded media, prompts, generated content — remains yours. You grant us a limited license to process and transmit it solely to operate the Service. Feedback and suggestions you send may be used without obligation.
10. No Guaranteed Rankings
Search engines are third-party platforms we do not control. The Service improves and automates local-SEO signals — geo-pages, map signals, GBP posting cadence — but we do not and cannot guarantee specific rankings, Map Pack placement, traffic, or revenue. Rank positions fluctuate with algorithm changes, competition, and proximity physics. Metrics shown (SoLV, rank grids, lift estimates) are measurement tools, not promises. This clause applies even if marketing materials describe typical outcomes.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted availability, error-free operation, or that AI output will be accurate, original, or suitable for any purpose.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) we are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost rankings, lost data, or business interruption; and (b) our aggregate liability for any claim relating to the Service is capped at the amounts you actually paid us in the 12 months preceding the claim, or $100 if you paid nothing.
13. Indemnification
You agree to indemnify and hold us harmless from claims arising out of: content you publish, misuse of the Service, violation of these Terms or third-party policies, actions taken under your account, and — for agency users — your client relationships and authorizations.
14. Termination
- You may cancel and delete your account anytime from Settings or by contacting support
- We may suspend or terminate for breach, abuse, fraud, or non-payment — with notice where practicable
- On termination: licenses end, scheduled automation stops, Google tokens are deleted, and paid periods run to their end without refund except as stated in Section 5
- Sections on IP, disclaimers, liability, and indemnification survive termination
15. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Delaware, except that either party may seek injunctive relief for IP misuse in any competent court. You waive class-action participation to the extent permitted by law.
16. Changes & Contact
We may update these Terms with 30 days' notice for material changes (posted in-app or emailed). Continued use after changes take effect means acceptance.
